No Fault Doctors are doctors who accept New York State No Fault Insurance. There are many types of doctors who accept this insurance and they can be hard to find. Many people do not know about or understand No Fault Insurance, so let’s explore this.

On February 13th, 1973 Insurance Law 5102 was enacted and went into effect on February 1st, 1974. New York State created the No Fault Insurance Law to eliminate frivolous lawsuits, which tied up the courts. Instead, law makers wanted a system which took care of the medical benefits for people who were seriously injured in automobile accidents. The law basically states that no matter who is at fault for the motor vehicle accident, the car that you were in, or if you were a pedestrian, the car you were struck by will cover your medical costs. It is important to understand that the law only covers motor vehicles such as trucks, cars, buses, but not motor cycles.

No Fault Benefits

New York State No Fault Insurance will provide benefits coverage of up to $50,000 per person in the car you were in. Benefits include medical coverage, wage loss (80% of your salary) up $2,000 per month for up to 3 years and all other reasonable expenses up to $25 per day for one. Reasonable expenses can include baby sitter expenses while you go to see a medical professional or transportation expenses to go there.

Exclusions From No Fault Coverage

There are specific exclusions from the no fault law for coverage. An insurance company can exclude you from benefits if:

1. The act was intentional (ie… a staged auto accident)

2. The driver was impaired by alcohol or drugs

3. While committing an act which would constitute a felony, or seeking to avoid an arrest from a peace officer;

4. While operating a speed test or race; or

5. While operating a stolen automobile.

30 Days to File

It is important to understand that New York State gives you 30 days to inform your insurance carrier that you were involved in a motor vehicle accident. You must file an NF2 form to your insurance carrier within 30 days from the date of accident, or 45 days (if you have a good reason). Your insurance carrier will ask you why you did not contact them within the legal required period of time. Failing to do will jeopardize your insurance coverage. A possible excuse could be that you were seriously injured and hospitalized and had not retained an attorney who could make you aware of the law and file the required paper work.

45 Days to Present Your Bills to Insurance Carriers

You must also present your hospital bills within the first 45 days or your insurance carrier will not be responsible for paying your bills. This means that you could be responsible for all or some of your medical bills.

Finding Doctors Who Accepts No Fault Insurance

If you or someone you know has been seriously injured in a car accident then you will need to find a doctor who accepts no fault insurance. You may need a dentist if you cracked your tooth, a plastic surgeon if you cut your face, an orthopedic surgeon if you sustained a compound fracture, or a psychologist or psychiatrist due to mental anguish from your auto accident. There are many reasons that you may need a doctor.

Any doctor licensed in the State of New York can accept no fault insurance. Many shy away from it because they don’t understand it or know how to bill the insurance carrier. Over the years there have been a plethora of No Fault Clinics which comprise medical doctors, physical therapists, acupuncturists, and chiropractors. In the early 2000’s a lot of these clinics were considered mills and were created to bilk the insurance carriers out of billions of dollars. The offices often provided their clients very poor quality medical treatment. They often gave unnecessary tests or charged for treatment that was never given to the patients. Many patients were manufactured by gangs of runners who recruited people to stage phony auto accidents.

This has painted a very bleak picture for the No fault Insurance Industry. Insurance companies have been very skeptical of these mills, so they tend to give these doctors a hard time. The result is that many doctors who do not understand this field will not get involved with this type of insurance.

Just type the borough, city, or zip code where you would like to find your medical professional.
